Retainer Fee-

• The Retainer Fee varies from $50-$300 depending on type of session and is due at the time of booking and reserves the Client's session date.  Retainer Fee is made through the Photographer using a Credit Card, cash, pay pal or a check can be mailed. Fee is Non-refundable but can be used towards future session if any party has to reschedule. New session must be scheduled within 60 days to apply retainer fee. 

Rescheduling-

• 24 hours notice before the session is needed if the Client would like to reschedule. The Retainer fee will be held and applied to the rescheduled session, only one reschedule is allowed.  Any cost for location usage will be paid for by the Client.  The Client has 60 days to reschedule the session if there is availability. If Client needs to postpone the session due to sickness or family emergency, then a time mutually agreed upon Client and Photographer will be scheduled. If one is not chosen within 30 days of the original date, their session fee is forfeited. Photographer maintains the right to reschedule if needed due to inclement weather, illness, emergency, etc. No refund is available if the session is cancelled by the Client. Retainer Fees can only be used towards rescheduled sessions.  Photographer not responsible for any Covid-19 related changes to venues or parks. 

Cooperation/Late/No Shows:

• The Photographer is not responsible if the Client and/or key individuals fail to appear or cooperate during the session, or for missed images due to details not revealed to the Photographer. If the Client and/or key individuals fail to appear to a scheduled portrait session, the Retainer Fee is non-refundable.  If the Client is more than 20 minutes late, their session is cancelled and they will need to re-book (and pay) for another session. They loose their session retainer.

Session Request:

• Please try to arrive up to 10 minutes prior to your allotted session time.  Arriving late may result in fewer images due to the shortened time frame. , If the Photographer is late, your session time will be extended by the same number of minutes. This agreement, including the Model Release, must be signed before the session. Unsigned Agreements = no photo session.  Please contact The Photographer, before the session, to discuss and and explain any questions the Client may have.

Re-shoots:

• Re-shoots are determined at the sole discretion of the Photographer.  In the unlikely event that the Client is completely dissatisfied with the final results. The Photographer will re-shoot at a 50% discount on the original Session Fee.  The Client is then able to order prints from the second portrait session only.  In the unlikely event that the finished product from a portrait session is unusable due to technical problems (camera failure or exposure problems), the Photographer will re-shoot at no additional charge. Please try to make the most of the session and help avoid any need to re-shoot.

Weather:

• If it is not possible for a session to take place on a scheduled day due to weather, the Photographer and Client will reschedule on an agreed upon date at the earliest date possible, with no additional charge.

Copyright & Penalties

• The Photographer has full copyright ownership to any photographs he/she captures.  All Images are protected under Federal Copyright Law and remain the copyright of the Photographer.  It is Illegal to copy, scan, download, print, modify, re-produce, or otherwise steal any image created by the Photographer unless given consent in the form of a Copyright Release or Print Release.  This applies to images posted in a Private Online Gallery, Blog, Facebook, Instagram, Hard Copy Images, etc. If the Client steals images via any method above or any other method, the Client will be charged legal fines and invoiced for the cost of EACH digital image stolen, at the Photographer's current price per image.  Printing rights are not the same as Copyright.  If you, the Client, have any questions regarding copyright and the use of photographs please contact the Photographer. Most galleries come with a Print Release unless otherwise stated. 

Delivery of Images:

• The Photographer will handpick the session's best images and send a gallery of Proofs. Once you have chosen your favorites (amount of images depends on package) I will fully edit your chosen images.  Each of these images will be retouched and enhanced based on the Photographer's artistic vision.  The Photographer reserves the right to edit and release only those deemed creditable as profession in quality and within Photographer's artistic standards.  If requested: Sneak peeks will be posted on social media with in 3 days of session. Proof gallery sent with in 1 week of session. Final fully edited images will be sent with in 1 week of clients final image choices. Additional images above the package amount are available to purchase. Ask photographer for current pricing. 

Digital Images/Social Media:

• Digital Images may be purchased in addition to or included with your session.  These are delivered to your private online gallery.  You will receive high-resolution images for unlimited personal printings which can also be used for web and social media purposes.  The Client may share blog post links, Facebook posts, etc through the use of the share functions and dissemination of direct links.  The Client shall not copy, download, screenshot, or capture the photographs in any other fashion.  Please leave the watermark on the Photographer photos when sharing from the Photographer's social media.   Photos posted online without the watermarks are allowed as long as photo credit is given to the Photographer.  

Payments:

• Payments are accepted via Credit Card (PayPal or Square), Venmo, Checks made out to the Photographer's first and last name, Cash, or Money Orders.  A $25 fee applies for any returned check. The Photographer will email you a invoice within 48 hours of booking.  Payment or retainer fee is due within 48 hours of scheduling your session.  If payment is not received your session date/time will be made available to other clients. 

Credits:

• Gift Certificates, Special Offers and, other credits are non-transferable and are not redeemable for cash.

Social Media & Marketing:

• I understand that my photos may be used by the photographer for marketing or advertising and/or on social media. April Bentley Photography will never post your images online or otherwise without your verbal permission.
